In accordance with the “Legal Notice” of this website and the General Data Protection Regulation, we set out below the legally required information on how our organisation processes your personal data.

• Postal address: C/ Vélez Málaga 5, Portal 2, 2ª planta, puerta 3, San Pedro Alcántara, Marbella (Málaga), Spain.

For what purposes do we process your personal data?

We process the personal data you provide to us through this website or by other means (for example, social media) for the following purposes:

To contact you and respond to your request, enquiry, query or suggestion. You are not obliged to provide the personal data requested by this website; however, if you do not, we will not be able to respond to your request, enquiry, query or suggestion.

To send commercial communications about our products or services, unless you have told us otherwise by ticking the opt-out box that Agencia IA Marbella Dev may have made available to you when your data was collected, or by letting us know by any other means. In any case, giving permission to process your data for this purpose is voluntary, and refusing would only mean that you would not receive commercial offers for our products or services.

To provide commercial information to people who follow Agencia IA Marbella Dev on social media. Becoming a friend or follower of Agencia IA Marbella Dev is a voluntary act, but doing so necessarily implies authorisation to process data for this purpose. If you wish to stop receiving this information or to have your data deleted, you can unfollow our profile.

To handle customer service queries received through instant messaging channels (WhatsApp Business and Instagram Direct) on behalf of our clients, using automated response systems based on artificial intelligence, in order to offer 24/7 customer service. In accordance with the European Union’s Artificial Intelligence Act (EU AI Act), users of these systems will be told at the start of each conversation that they are interacting with an artificial intelligence system.

You may withdraw your consent for any of these purposes by emailing info@marbella.dev.

How long will we process your data for?

The personal data you provide to us will be kept indefinitely, until you tell us that you wish it to be deleted.

What is the legal basis for processing your data?

The legal basis for processing your data is the consent we request from you, which you may withdraw at any time. Withdrawing your consent will not affect the processing carried out before it was withdrawn, which will not become unlawful as a result.

Which recipients will your data be disclosed to?

Your data will not be disclosed to third parties, other than the data processors needed to provide our services. We work with the following providers, which may have access to personal data: Google LLC (Google Sheets, Google Drive, Google Gemini) for data storage and AI processing; Anthropic PBC for artificial intelligence language processing; and Hostinger International Ltd for server hosting. All processors are contractually bound to maintain appropriate data protection standards.

What are your rights when you provide us with your data?

Anyone has the right to obtain confirmation of whether or not we are processing personal data that concerns them. Data subjects have the right to access their personal data, to request the rectification of inaccurate data and, where applicable, to request its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

Under the conditions set out in the General Data Protection Regulation, data subjects may request the restriction of the processing of their data or its portability, in which case we will keep it only for the establishment, exercise or defence of legal claims.

In certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data. If you have given your consent for a specific purpose, you have the right to withdraw it at any time, without affecting the lawfulness of processing based on consent before its withdrawal. In these cases we will stop processing the data, or stop processing it for that specific purpose, except for compelling legitimate grounds or for the establishment, exercise or defence of legal claims.

All of the rights mentioned above can be exercised using the contact details given at the start of this clause.

Followers on social media can exercise the rights granted to them by the General Data Protection Regulation, as set out in this section, although, since these platforms belong to third parties, Agencia IA Marbella Dev’s responses to the exercise of those rights will be limited by the functionality that the social network in question allows.

In any event, if your rights are infringed, particularly if you have not obtained satisfaction when exercising them, you may lodge a complaint with the Spanish Data Protection Agency (contact details at www.agpd.es) or another competent supervisory authority. You can also obtain more information about your rights by contacting these bodies.

What are your obligations when you give us third-party data?

If you give us data about third parties, you accept responsibility for informing them beforehand of all the provisions of Article 14 of the General Data Protection Regulation, under the conditions it lays down.
